Terms of Use

These Terms of Use (the “Terms”) govern your use of the Nova DictateiOS application and related backend service operated by NOVA INDIE (the “Service”). By using the app or completing a purchase you agree to these Terms and to Apple's Standard EULA for Licensed Application End Users, incorporated by reference. Where they conflict, these Terms control for Service-specific matters.

1. The Service

Nova Dictate uses Apple's on-device Speech Recognition to convert your live speech into text transcripts. Speech recognition processing happens locally on your device. The app also offers optional AI text enhancement features (such as grammar polishing, reformatting, and text summarization) powered by OpenAI's API. The backend manages your anonymous account, token balance, and purchase status. The Service is provided “as is” and “as available.”

2. Account & free tier

  • On first launch, an anonymous guest account is created and tied to a device identifier. No sign-in is required.
  • Each device receives a one-time free allowance of 3 minutes of dictation. Minute usage is tracked and deducted from your token balance.
  • The free allowance is granted once per device. Deleting your account and registering again on the same device does not restore or reset the free allowance.

3. Subscriptions — auto-renewable

  • Plans:
    • Nova Dictate PRO Monthly, USD 4.99 / month — unlimited dictation.
    • Nova Dictate PRO Yearly, USD 34.99 / year — unlimited dictation (save 40%).
  • Introductory offer. Eligible new subscribers may receive a 3-day free trialof Nova Dictate PRO through Apple's App Store. During the trial you have full PRO access (unlimited dictation). Apple shows the exact price and trial terms on the purchase sheet before you confirm.
  • Billing. If you start the introductory offer, your Apple ID is charged when the 3-day trial ends, unless you cancel at least 24 hours before the trial ends. If you are not eligible for the introductory offer, payment is charged at confirmation of purchase.
  • Auto-renewal. The subscription renews automatically each period unless you cancel at least 24 hours before the end of the current period. Apple will charge the renewal within 24 hours prior to the end of the current period.
  • Management & cancellation.You can review, manage and cancel the subscription at any time in  Settings → Apple ID → Subscriptions on the same Apple ID used to purchase. Cancellation stops future renewals; the current period (including any active introductory trial) remains usable until expiry.
  • Starting Nova Dictate PRO immediately ends any remaining guest trial minutes (section 2).

4. Consumable token packs

  • Token packs are one-time consumable purchases:
    • Starter Pack — 60 minutes, USD 1.99
    • Pro Pack — 300 minutes, USD 7.99
  • Token packs can be purchased by both free users and PRO subscribers.
  • Token minutes never expire.
  • Dictation duration is rounded up to the next whole minute to determine the minutes deducted from your balance.

5. Refunds

Subscriptions and token packs are purchased through the Apple App Store. Refunds are handled by Apple, in accordance with Apple's policies, at reportaproblem.apple.com. Please see our Refund Policy for details.

6. Content ownership & AI Processing

  • You retain full ownership of any text generated from your speech or edited by AI features.
  • You are responsible for the content you dictate or process. Do not use the Service or AI features to produce content that is unlawful, harmful, or violates third-party rights or OpenAI's Usage Policies.
  • When you invoke optional AI features, text is transmitted securely to OpenAI's API. Per OpenAI's API policies, data sent via API is not used for AI model training.
  • Your raw audio recordings stay on your device and are never sent to OpenAI or cloud servers.

7. Termination

We may suspend access if you violate these Terms. You may stop using the Service at any time and request account deletion. See our Account Deletion guide.

8. Limitation of liability

To the maximum extent permitted by law, NOVA INDIE is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Transcription accuracy depends on microphone quality, ambient noise, language, and Apple's Speech Recognition engine.
